HC revokes notification on DMB administrator

DIBRUGARH, June 11 – The BJP here expressed a sense of relief at the revocation of the earlier notification of the Department of Urban Development, Government of Assam that appointed an administrator of the Dibrugarh Municipal Board (DMB), following a Gauhati High Court judgement.

The alleged arbitrary appointment of the administrator with the ruling party background at the expiry of the term of the elected Municipal Board, flouting the norms and not holding elections to the Municipal Board was disturbing to the BJP, who could not but challenge the appointment. The Dibrugarh Nagar Mandal Committee of the BJP considers the High Court order a moral victory of the people and an assurance of the rule of law.

It was to the great relief of the party when the local MLA Prasanta Phukan, who is also an ex-officio member of the Municipality, decided to challenge the government notification in the court of law, a press statement of the Nagar Mandal committee of the BJP said.

Phukan through a writ petition WP(C) No. 613/09 in the High Court challenged the appointment of the administrator in Dibrugarh Municipality. The High Court after hearing the petitions had on May 29 last directed the State Government to appoint government officials in place of administrator with immediate effect and hold fresh elections to the Urban local bodies within a set time frame.

It may be mentioned that following the court’s judgement, the department of Urban Development, Government of Assam issued notification No. UDD (M) 10/2009/129 dated June 6, 2009 revoking its earlier notification on the appointment of the administrator. However, the party expressed surprise that despite the notification, the administrator in question continues to hold the office till date.
